The present general sales conditions is establishing the détails of the relation between two parties : Nomad Ocean Aventures Diving Center referred to as N.O.A., ( License number: 05920, po box 51936 Dubaï UAE) being the first party and any private Professional individual or Professional entity wishing to purchase services with the said first party ( N.O.A).
The individual after agreeing to this contract agrees to its conditions and admit having taking knowledge of its content in its integrity.
The first party declares it will not trade with or provide any services to OFAC and sanctioned countries.
The current général sales conditions have for purpose to define the rights and obligations of both parties for the activities and services N.O.A offers.
The présent agreement describes the payment schedules upon booking and delivery of the offered services. This document also stipulâtes also all the steps required to confirm a booking and guarantee the services delivery to the second party.
Services of the diving centers
It is therefore agreed that the second party will be receptioned for the accomodation in Oman on the premises of N.O.A guesthouse it twill include : Accomodation on shared basis unless specified otherwise, Non alcoholic beverages, 2 dives per day, 2 x 12 liter aluminium tanks. Nitrox is also offered to guest for free but is subject to availibily and is at the discrétion of N.O.A.
For the operations in Fujairah, the guest of the second party will be housed within the hôtel the royal beach hôtel and all diving activity will take place upong it’s base located on the premises of the hôtel.
The operator or dive center manager reserves the right to refuse a diver to go diving or any diver or person not in pocession or proof of diving certification and/or logbook that can proove the past expérience of the diver. The operator and dive center manager reserves the right to refuse a client to undertake diving activity if their or any other divers safety is at stakes due to alcholol or drug intoxication, rash behavious or any other reason that could cause any harm.
The operator will not reimburse any cancellation due to weather, poor visibility, mechanical issue, acts of god or illness of the client that would prevent any subaquatic activities.
However at the discrétion of N.O.A in the évent of unplanned cancellation, the operator will do what he can to replace the activity with another one or offer additional dives on remaining diving days.
The dive center is operating Under the standards of practice of PADI and as of such will only follow the safety and standards practices and guidelines of PADI and without exception.
The first party denies any responsibility if the second party booking is cancelled due to being able to produce required documents to engage in scuba diving. Such documents can be requested by the coast guards or the immgration. If the second party breaches the law and cannot commit to his booking the first party denies any obligation to offer the service and i twill be considered as a cancellation from the first party.
booking and cancellation policies
For every booking taken the second party takes the responsibility to take precautions under the conditions described below.
Participants must be of legal age ( 18 years old) if not they must be in company of their legal guardian, participants must have guarantees and insurances especially in terms of diving fitness in the respect of diving practices and must have a médical aprouval for diving activities.

A booking is considered confirmed only upon the receipt of the entire payment upon receipt of invoice, however a prebooking can be offered for bookings that are for more than 1 month a prepayment of 30% will be requested to secure this prebooking in the eventuality of cancellation form the second party the first party will withhold the 30% downpayment
The second party understand that first party is subjected to the légal sytem of the uae and that terms of service can be changes againt it’s will between the time of booking and the service provided. Prices quoted are subject to change without any notice
-Once a service is booked second party understand that there is no refund and can not request for reversal of payment.
Cancellation policies for individuals :
-In case of cancellation after 1 month of the booking time 100% of the amount will be retained.
-Any cancellation prior to 1 month of a prebooking with a 30% downpayment will result in the whole sum being retained.
The services listed in 3. With packages or for day trips excludes the following :
-Rental diving equipment
-Damage to rental equipment or poperty of the first party
-Insurances in case of cancellation or médical injury
-Training or certifications
-Loss, theft or damage of personal property for diving or other
-Pictures or any other media
-Medical care or any air transport emergency or other of any nature
-Bank charges or visas fées
-Soft drinks on the premises
-Transportation to and from the location of the first party.
By bank transfer : the totality of the payment for the given service is due upon réception of the invoice and will be retained as per this contractual document
Payments sent to the first party must be grouped and sent prior to the arrival of any guest in one payment. Are excluded transfer fee any bank charges arisen will be at the charges of the second party even in the case where an internmediary bank is required for completing transfers.
Any déviation in payment schedules will result in no services being provided to the guest and booking being canceled with immédiate effect.
PAYMENT BY CARDS TERMS AND CONDITION
-Payments can be done by visa and master card if it is the case a charge of 3% will apply to cover expenses of payments.
-Cardholder must retain a copy of transaction records and Merchant policies and rules.
Payments can be done in euros or in AED, UAE dirhams.
-Second party is responsible for maintaining the confidentiality of his account
The first party will notify the second party of réception of payment by the second party by email.
validity of this agremment
The present conditions are to be applied to the entire services offered by nomad to second parties and are to be applied for any services booked. United Arab Emirates is our country of Domicile and the governing law is the UAE law
– All credit/debit cards’ details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties.
– Merchant will not pass any debit/credit card details to third
– Merchant takes appropriate steps to ensure data privacy and security including through various hardware and software methodologies. However, (first party) cannot guarantee the security of any information that is disclosed online
– The merchant is not responsible for the privacy policies of websites to which it links. If you provide any information to such third parties different rules regarding the collection and use of your personal information may apply. You should contact these entities directly if you have any questions about their use of the information that they collect.
-The Website Policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore, the Customers’ are encouraged to frequently visit these sections to be updated about the changes on the website. Modifications will be effective on the day they are posted.
Terms of agreement
The second party understands that by making a booking and payment with the first party it therefore agrees to the this agreement. The first party declines any responsibility if the second party denies having taken notice and/or knowledge of this agreement.
